Acceptance of Terms

By accessing or using Bastion Recovery Services (“the Service”), operated by Bastion Recovery Services at bastionrecoveryservices.com and through our mobile application, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

Service Description

Bastion Recovery provides an automated detention claims recovery platform for owner-operator truck drivers. The Service includes:

  • AI-powered extraction of load details from Rate Confirmation emails
  • GPS-based tracking of detention time at warehouse facilities
  • Automated generation of professional proof packets with GPS timestamps and BOL photos
  • Submission of detention claims to freight brokers on your behalf
  • Monitoring of broker responses and payment collection tracking

We charge a 20% commission on successfully collected detention pay. You are only charged when the broker approves payment.

User Accounts

Account Creation: You must provide accurate, complete, and current information during registration. You are responsible for maintaining the confidentiality of your account credentials.

Phone Verification: A verified phone number is required for SMS notifications about detention time expiration. You will receive a verification code via SMS during signup.

One Account Per User: Each user may maintain only one active account. Multiple accounts by the same individual are prohibited.

Eligibility: You must be at least 18 years old and legally authorized to operate commercial vehicles in the United States.

Commission and Payment

Commission Rate: We charge 20% of the gross detention pay collected from the broker. For example, if the broker pays $500 in detention, you receive $400 and we collect $100.

Payment Method: You must provide a valid credit card when you approve your first detention claim proof packet. Card information is securely stored by Stripe.

Authorization Hold: When you approve a proof packet for submission to the broker, we place a 7-day authorization hold on your card for the calculated commission amount. This hold does not charge your card.

Charge Only on Success: The authorization hold is captured (charged) only if the broker approves payment. If the broker denies the claim or does not respond within 7 days, the hold is released and you are not charged.

Payment Timeline: Commission charges occur when we detect broker approval via email response or when the broker processes payment through their accounting system.

Payment Processor

All payment processing is handled by Stripe, Inc. By using the Service and providing payment information, you also agree to be bound by Stripe's Terms of Service.

  • Statement Descriptor: Charges from Bastion Recovery will appear on your credit card statement as “BASTION RECOVERY” or “BASTION REC SVC”
  • Disputes: If you believe a charge is incorrect, contact us at claims@bastionrecoveryservices.com within 30 days. We will review and resolve billing disputes before they escalate to chargebacks
  • Refunds: If a commission was charged in error (e.g., broker later reverses payment), we will issue a full refund within 5-10 business days

SMS Terms & TCPA Consent

By providing your phone number and checking the SMS consent box during registration, you provide your express written consent under the Telephone Consumer Protection Act (TCPA) to receive autodialed SMS messages from Bastion Recovery Services at the phone number you provided. This consent is not a condition of purchasing any goods or services.

  • Message Types: Phone verification codes, detention free-time expiration alerts, claim status updates (submitted, approved, denied), and account security notifications
  • Message Frequency: Varies based on your active loads and claim activity. Typically 1-5 messages per active load. You may receive up to 15 messages per month during active usage
  • Opt-Out: Text STOP to any message to unsubscribe from all non-essential SMS. You will receive a confirmation message. Critical security messages (e.g., verification codes) may still be sent when you initiate an action
  • Opt-In: Text START to resume receiving SMS messages after opting out
  • Help: Text HELP for assistance, or email claims@bastionrecoveryservices.com
  • Carriers: Compatible with all major US carriers including AT&T, T-Mobile, Verizon, and others. Carrier participation may vary
  • Cost: Message and data rates may apply depending on your mobile carrier plan. Bastion Recovery does not charge for SMS messages, but your carrier may

User Responsibilities

You agree to:

  • Forward Rate Confirmations: Accurately forward Rate Confirmation emails to load@bastionrecoveryservices.com immediately upon acceptance of a load
  • Enable GPS Tracking: Grant location permissions to the mobile app and keep it running in the background during loading/unloading to ensure accurate detention time tracking
  • Upload BOL Photos: Take clear photos of the stamped Bill of Lading showing delivery timestamps
  • Honest Claims: Submit only legitimate detention claims based on actual time spent waiting at facilities (fraud will result in immediate account termination)
  • Review Proof Packets: Carefully review the generated proof packet before approval to ensure accuracy of GPS data, detention calculations, and claim amounts
  • Cooperate with Brokers: Respond to broker inquiries about claims in a professional and timely manner if contacted directly

Third-Party Service Providers

The Service relies on the following third-party providers to deliver core functionality:

  • Stripe, Inc. — Payment processing and credit card storage. Stripe operates independently and is subject to its own terms and privacy policy
  • Twilio, Inc. — SMS message delivery for phone verification and detention alerts. Twilio operates independently and is subject to its own terms and privacy policy

Bastion Recovery is not responsible for the acts, omissions, or policies of these third-party providers. Your use of their services is governed by their respective terms. We select providers that meet industry security standards but cannot guarantee their performance or availability.

Limitation of Liability

No Guarantee of Success: While we work diligently to collect detention pay on your behalf, we do not guarantee that any specific claim will be approved or paid by the broker. Brokers have final discretion over payment decisions.

Not a Law Firm: Bastion Recovery is not a law firm and does not provide legal advice. The Service is an administrative claims collection tool, not legal representation.

GPS Accuracy: While we use industry-standard GPS technology, accuracy may be affected by device hardware, weather conditions, urban interference, or facility layout. We are not liable for GPS inaccuracies that affect claim calculations.

Third-Party Services: We rely on third-party services (Stripe, Twilio, email providers) that may experience outages or service disruptions. We are not liable for losses resulting from third-party service failures.

Maximum Liability: Our total liability for any claim arising from use of the Service is limited to the amount of commissions you paid in the 12 months preceding the claim.

Intellectual Property

Service Ownership: Bastion Recovery owns all rights, title, and interest in the Service, including software, algorithms, designs, and trademarks. You are granted a limited, non-exclusive, non-transferable license to use the Service.

Your Data: You retain ownership of your Rate Confirmations, BOL photos, GPS data, and other content you provide. By using the Service, you grant us a license to process this data for the purpose of generating and submitting detention claims on your behalf.

Termination

Your Right to Terminate: You may delete your account at any time through the app settings. Pending claims will be processed to completion, and commissions for approved claims will still be charged.

Our Right to Terminate: We reserve the right to suspend or terminate your account if you violate these Terms, engage in fraudulent claims, or abuse the Service. Termination does not waive commission charges for claims already submitted to brokers.

Effect of Termination: Upon termination, your access to the Service will cease. Your data will be retained or deleted according to our Privacy Policy and legal retention requirements.

Dispute Resolution

Binding Arbitration: Any disputes arising from these Terms or use of the Service will be resolved through binding arbitration rather than in court, except for disputes that qualify for small claims court.

Governing Law: These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.

Class Action Waiver: You agree to resolve disputes on an individual basis only. You waive the right to participate in class actions or class-wide arbitration.

Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or in-app notification. Your continued use of the Service after changes constitutes acceptance of the updated Terms.
